These Terms of Use ("Terms") are a legal agreement between you and Mehmet Kurtgöz ("the Developer", "we") for the FootWordle mobile application and related services ("the Service"). By downloading or using FootWordle you accept these Terms and the Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (16 in the EEA/UK) and able to form a binding contract. If you use FootWordle on behalf of a minor for whom you are responsible, you accept these Terms for them.

2. Account and sign‑in

You sign in with Google or Apple. You are responsible for keeping access to that account secure and for all activity under your FootWordle account. Provide accurate information and keep it up to date.

3. Licence

We grant you a personal, limited, non‑exclusive, non‑transferable, revocable licence to install and use FootWordle on devices you own or control, for personal, non‑commercial entertainment, in accordance with these Terms and the applicable app‑store rules.

4. Virtual items and credits

  • Credits, player cards, card levels and similar items are a limited licence to use in‑game features. They are not your property, have no monetary value, and cannot be exchanged for cash or transferred outside the app.
  • Purchased credits are generally non‑refundable except where required by law or the app store's policy.
  • We may change, balance, expire or remove virtual items and earning rates to keep the game fair and functional.
  • Any credits or items remaining are forfeited if your account is closed or terminated.

5. In‑app purchases

The Service may offer optional purchases, including one‑time purchases and, where available, auto‑renewing subscriptions. All purchases are sold and billed by the Apple App Store or Google Play under their terms, and charged to your store account on confirmation. Any auto‑renewing item continues until you cancel it in your store account settings; deleting the app does not cancel it. Refunds and cancellations are handled by Apple or Google under their policies.

6. Acceptable use

You agree not to: cheat, use bots, automation, scripts or modified clients; exploit bugs or manipulate leaderboards, scores or the economy; reverse engineer, decompile or tamper with the app except where allowed by law; access the Service through unofficial means; upload unlawful, infringing, hateful or offensive content, including in usernames; or use the Service in violation of any law or third‑party right.

7. User content

You are responsible for content you provide (such as your username). You grant us a worldwide, royalty‑free licence to host and display it to operate the Service, including on the leaderboard. We may remove content or reset a username that breaches these Terms.

8. Fair play and enforcement

We may investigate suspected breaches and, at our discretion, reset statistics, remove entries from leaderboards, revoke virtual items, and suspend or terminate accounts.

9. Intellectual property

The Service, including its software, design, the "FootWordle" name and logo, and the selection and arrangement of its data, is owned by the Developer and protected by law. Club names, competition names, player names and related factual data are the property of their respective owners and are used for identification and descriptive purposes only. FootWordle is not affiliated with, endorsed by or sponsored by any club, league or governing body.

10. Third‑party services and stores

The Service relies on third parties (Apple, Google, Firebase, RevenueCat, Yandex AppMetrica, AdMob). Your use of their features is also subject to their terms, and we are not responsible for third‑party services.

Apple App Store additional terms

These Terms are between you and the Developer only, not Apple. Apple has no obligation to provide maintenance or support for FootWordle. Apple is not responsible for any product warranties, claims of non‑conformity, product liability, third‑party intellectual‑property claims, or consumer‑protection claims relating to the app; such matters are the Developer's responsibility to the extent required by these Terms and applicable law. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist‑supporting", and that you are not on any U.S. Government restricted‑party list. Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that it will be uninterrupted, error‑free or that data (including football information) is accurate or complete.

12. Limitation of liability

To the fullest extent permitted by law, the Developer is not liable for indirect, incidental, special, consequential or punitive damages, or loss of data, virtual items or profits. Our total liability for any claim relating to the Service is limited to the amount you paid us for it in the 12 months before the claim, or USD 50 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law, or your mandatory consumer rights.

13. Indemnification

You agree to indemnify the Developer against claims arising from your misuse of the Service or breach of these Terms.

14. Termination

You may stop using the Service at any time. We may suspend or end your access if you breach these Terms or where necessary to protect the Service or other users. Sections that by their nature should survive (e.g. IP, disclaimers, limitation of liability) continue after termination.

15. Changes

We may modify the Service or these Terms. We will post the updated Terms here with a new date and, for material changes, provide notice in the app. Continued use after changes take effect means you accept them.

16. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict‑of‑laws rules, and the courts of İstanbul have jurisdiction, unless mandatory consumer law in your country of residence provides otherwise.

Bu Kullanım Koşulları ("Koşullar"), FootWordle mobil uygulaması ve ilgili hizmetler ("Hizmet") için seninle Mehmet Kurtgöz ("Geliştirici", "biz") arasındaki hukuki bir sözleşmedir. FootWordle'ı indirerek veya kullanarak bu Koşulları ve Gizlilik Politikası'nı kabul edersin. Kabul etmiyorsan Hizmet'i kullanma.

1. Uygunluk

En az 13 yaşında (AEA/Birleşik Krallık'ta 16) olmalı ve bağlayıcı bir sözleşme kurabilecek durumda olmalısın. FootWordle'ı sorumlu olduğun bir küçük adına kullanıyorsan bu Koşulları onun adına kabul edersin.

2. Hesap ve giriş

Google veya Apple ile giriş yaparsın. Bu hesaba erişimin güvenliğinden ve FootWordle hesabın altındaki tüm etkinlikten sen sorumlusun. Doğru bilgi ver ve güncel tut.

3. Lisans

Sana; FootWordle'ı sahip olduğun veya kontrol ettiğin cihazlara kurup kişisel, ticari olmayan eğlence amacıyla, bu Koşullara ve ilgili uygulama mağazası kurallarına uygun olarak kullanman için kişisel, sınırlı, münhasır olmayan, devredilemez ve geri alınabilir bir lisans veririz.

4. Sanal öğeler ve krediler

  • Krediler, oyuncu kartları, kart seviyeleri ve benzeri öğeler; oyun içi özellikleri kullanmak için sınırlı bir lisanstır. Bunlar senin mülkün değildir, parasal değeri yoktur ve nakde çevrilemez veya uygulama dışına aktarılamaz.
  • Satın alınan krediler, yasa veya uygulama mağazasının politikası gerektirmedikçe genellikle iade edilemez.
  • Oyunu adil ve işlevsel tutmak için sanal öğeleri ve kazanç oranlarını değiştirebilir, dengeleyebilir, süreyle sınırlayabilir veya kaldırabiliriz.
  • Hesabın kapatılır veya sonlandırılırsa kalan tüm kredi veya öğeler geçersiz olur.

5. Uygulama içi satın alımlar

Hizmet; tek seferlik satın alımlar ve uygun olduğu yerlerde otomatik yenilenen abonelikler dâhil isteğe bağlı satın alımlar sunabilir. Tüm satın alımlar; Apple App Store veya Google Play tarafından kendi koşulları kapsamında satılır ve faturalandırılır ve onayda mağaza hesabından tahsil edilir. Otomatik yenilenen herhangi bir öğe, mağaza hesabı ayarlarından iptal edene kadar devam eder; uygulamayı silmek bunu iptal etmez. İadeler ve iptaller, kendi politikaları kapsamında Apple veya Google tarafından yürütülür.

6. Kabul edilebilir kullanım

Şunları yapmamayı kabul edersin: hile yapmak, bot, otomasyon, komut dosyası veya değiştirilmiş istemci kullanmak; hataları istismar etmek veya liderlik tablolarını, puanları ya da ekonomiyi manipüle etmek; yasanın izin verdiği durumlar dışında uygulamayı tersine mühendislik yapmak, kaynak koda dönüştürmek veya kurcalamak; Hizmet'e resmî olmayan yollarla erişmek; kullanıcı adları dâhil hukuka aykırı, ihlal edici, nefret içeren veya saldırgan içerik yüklemek; ya da Hizmet'i herhangi bir yasayı veya üçüncü taraf hakkını ihlal edecek şekilde kullanmak.

7. Kullanıcı içeriği

Sağladığın içerikten (kullanıcı adın gibi) sen sorumlusun. Hizmet'i işletmek için, liderlik tablosu dâhil, bunu barındırmamız ve göstermemiz amacıyla bize dünya çapında, telifsiz bir lisans verirsin. Bu Koşulları ihlal eden içeriği kaldırabilir veya bir kullanıcı adını sıfırlayabiliriz.

8. Adil oyun ve yaptırım

Şüpheli ihlalleri araştırabilir ve kendi takdirimizle istatistikleri sıfırlayabilir, liderlik tablolarından kayıt kaldırabilir, sanal öğeleri geri alabilir ve hesapları askıya alabilir veya sonlandırabiliriz.

9. Fikri mülkiyet

Yazılımı, tasarımı, "FootWordle" adı ve logosu ve verilerinin seçimi ve düzenlenmesi dâhil Hizmet, Geliştiriciye aittir ve yasayla korunur. Kulüp adları, turnuva adları, oyuncu adları ve ilgili olgusal veriler ilgili sahiplerine aittir ve yalnızca tanımlama ve betimleme amacıyla kullanılır. FootWordle; hiçbir kulüp, lig veya yönetim kuruluşuyla bağlantılı değildir, onlar tarafından desteklenmez veya sponsorluğu üstlenilmez.

10. Üçüncü taraf hizmetleri ve mağazalar

Hizmet, üçüncü taraflara dayanır (Apple, Google, Firebase, RevenueCat, Yandex AppMetrica, AdMob). Onların özelliklerini kullanman ayrıca onların koşullarına tabidir ve üçüncü taraf hizmetlerinden biz sorumlu değiliz.

Apple App Store ek koşulları

Bu Koşullar yalnızca seninle Geliştirici arasındadır, Apple ile değil. Apple'ın FootWordle için bakım veya destek sağlama yükümlülüğü yoktur. Apple; uygulamaya ilişkin ürün garantilerinden, uygunsuzluk iddialarından, ürün sorumluluğundan, üçüncü taraf fikri mülkiyet iddialarından veya tüketici koruma taleplerinden sorumlu değildir; bu hususlar, bu Koşulların ve geçerli yasanın gerektirdiği ölçüde Geliştiricinin sorumluluğundadır. ABD Hükümeti ambargosu uygulanan veya "terörü destekleyen" olarak belirlenmiş bir ülkede bulunmadığını ve herhangi bir ABD Hükümeti kısıtlı taraf listesinde yer almadığını beyan edersin. Apple ve iştirakleri bu Koşulların üçüncü taraf lehdarıdır ve bunları sana karşı uygulayabilir.

11. Feragatnameler

Hizmet, yasanın izin verdiği en geniş ölçüde, hiçbir tür garanti olmaksızın "olduğu gibi" ve "mevcut olduğu şekilde" sunulur. Kesintisiz veya hatasız olacağını ya da verilerin (futbol bilgileri dâhil) doğru veya eksiksiz olduğunu garanti etmeyiz.

12. Sorumluluğun sınırlandırılması

Yasanın izin verdiği en geniş ölçüde Geliştirici; dolaylı, arızi, özel, sonuçsal veya cezai zararlardan ya da veri, sanal öğe veya kâr kaybından sorumlu değildir. Hizmet'e ilişkin herhangi bir talep için toplam sorumluluğumuz, talepten önceki 12 ayda bize ödediğin tutarla veya hiçbir şey ödemediysen 50 ABD doları ile sınırlıdır. Bu Koşullardaki hiçbir şey, yasa gereği sınırlandırılamayan sorumluluğu veya zorunlu tüketici haklarını sınırlamaz.

13. Tazminat

Hizmet'i kötüye kullanmandan veya bu Koşulları ihlal etmenden doğan taleplere karşı Geliştiriciyi tazmin etmeyi kabul edersin.

14. Fesih

Hizmet'i kullanmayı istediğin zaman bırakabilirsin. Bu Koşulları ihlal edersen veya Hizmet'i ya da diğer kullanıcıları korumak için gerekliyse erişimini askıya alabilir veya sona erdirebiliriz. Nitelikleri gereği devam etmesi gereken bölümler (ör. fikri mülkiyet, feragatnameler, sorumluluğun sınırlandırılması) fesihten sonra da geçerlidir.

15. Değişiklikler

Hizmet'i veya bu Koşulları değiştirebiliriz. Güncellenen Koşulları yeni bir tarihle burada yayımlarız ve önemli değişikliklerde uygulama içinde bildirim yaparız. Değişiklikler yürürlüğe girdikten sonra kullanmaya devam etmen, bunları kabul ettiğin anlamına gelir.

16. Geçerli hukuk

Bu Koşullar, kanunlar ihtilafı kurallarına bakılmaksızın Türkiye Cumhuriyeti yasalarına tabidir ve ikamet ettiğin ülkedeki zorunlu tüketici hukuku aksini öngörmedikçe İstanbul mahkemeleri yetkilidir.
